MONTGOMERY, Ala. (AP) - Parents with children already in private school will have to wait to find out if they will qualify for Alabama's new private school tax credits.

The Alabama Legislature decided not to address the issue when it approved other changes in the Alabama Accountability Act on Thursday. The architect of the tax credits, Senate President Pro Tem Del Marsh of Anniston, said the Republican majority was too divided over the issue to address it. Instead, it will be up to the state Revenue Department to decide.

A spokeswoman for the Revenue Department says there has been no decision.

Marsh believes the law does cover those already in private school if they are zoned for a failing public school. Teacher lobbyist Henry Mabry predicts it will end up in court.
