Court denies request to return cash seized in raid

BIRMINGHAM, Ala. (AP) — The Alabama Supreme Court has denied a man's request that more than $178,800 seized during a drug bust be returned to him.

The high court Friday issued a 10-page opinion upholding an earlier ruling by a Jefferson County judge.

Al.com reports (http://bit.ly/WWGvJt ) 41-year-old Derrick Ervin was arrested Feb. 16, 2006 during a drug bust being executed by federal Drug Enforcement Administration officials and local police. After the bust, authorities found a black bag and a shoe box containing bundles of cash.

Ervin was sentenced to 10 years in prison and a federal judge ordered money that was confiscated during the raid to be forfeited to the federal government. Ervin argued officials improperly transferred the money to federal authorities since the cash was seized under a state warrant.
