Alabama Appeals Court Orders Review of Prison Rule

MONTGOMERY, Ala. (AP) - The Alabama Court of Civil Appeals is ordering a judge in Montgomery to reconsider claims that Department of Corrections rules unfairly result in longer prison stays for men than women.

 

The judges unanimously ruled Friday that a lower court wrongly dismissed the claims by inmate Amos Charles Evatt.

 

Evatt filed suit claiming prison rules require male inmates to wait six months longer than women before they're eligible to enter a supervised re-entry program for prisoners. He says that means men wind up serving more time than women in Alabama prisons.

 

The appellate court says a judge didn't fully consider Evatt's lawsuit before ruling in favor of the prison system.

 

The judge's did uphold the court's decision to dismiss another part of Evatt's suit over prison smoking policies.
