Montgomery Public Safety Director Chris Murphy ells CBS 8 This Morning that the search of an East Montgomery home was scaled back, but not ended overnight.

Murphy said there were officers inside the house all night, although he is less confident  shooting suspect Desmonte Leonard is in the attic of the home than he was last night.

Murphy also told CBS 8 This Morning that someone sending fake tweets, purporting to be the gunman, will be prosecuted for giving false information to police.

A news conference is scheduled for 10:00am this morning in Auburn, by Auburn Police. Watch here on WAKA.COM and on air fro updates.

You can prosecute anyone who hinders in the investigation and/or apprehension of a wanted fugitive.

You can't prosecute someone for creating a fake twitter account. Parody is protected by free speech. Unless this fake account was communicating directly with police, they just need to wipe the egg of their faces and leave it alone.
