The Alabama Court of Criminal Appeals has upheld the capital murder conviction and death sentence given to a Montgomery man for the Jan. 20, 2003 beating deaths of an elderly couple during an apparent robbery and break-in at their home in Millbrook.

The appeals court Friday upheld the death sentence given to 64-year-old Charlie Washington.

Police say he was accused of killing 82-year-old Julian McKinnon and his 84-year-old wife Florence McKinnon. The bodies were found in their home. Washington had worked for the McKinnons as a handyman.

The appeals court rejected Washington's claim that he had ineffective counsel at his trial.

The ruling came during Washington's second round of appeals through the state and federal appellate court systems.
