PSC: Records Released to Newspaper Not Proprietary

Alabama Public Service Commission is explaining its decision to release records that are the subject of a court right between Alabama Gas Corp. and the Montgomery Advertiser.

A PSC statement says Alagasco sent a gas line safety plan to the agency without marking it as containing proprietary information.

The PSC says documents that aren’t marked as proprietary are considered public, so the agency released the plan at the newspaper’s request.

Alagasco filed suit, and a judge in Birmingham barred the newspaper from publishing information in the report.

The Advertiser says the ban is unconstitutional, but Alagasco says releasing sensitive information about gas lines could endanger the public.

The judge says he will hold a hearing Monday on whether to uphold the publication ban.
