The federal judge who overturned Alabama’s ban on same-sex marriage will hold a hearing tomorrow to determine if Probate Judges should be ordered to issue those licenses.

In Pike County, the probate judge took his office out of the marriage license business all together. And Judge Wes Allen doesn’t seem to be reversing his decision anytime soon.

So what financial impact does this have on the county? Last year the office issued about 216 licenses, totaling an estimate of 12-thousand dollars.

The probate office operates on a $491,000 dollar budget.

“the people of Pike Co. elected me to perform my duties but they also elected me because of who I am and the values I live by…I believe the Alabama constitution and federal law protect my right to live my life both as a Christian follower of Christ and also as an elected official.”

Alabama News Network spoke with the Pike County administrator who said he respects the judge’s decision.

The commission has no authority over the probate judge but the budget does come out of the county.
There’s been no problems so far but there’s fear of litigation.
