Family of Man Killed by Police Files Lawsuit Against City

The family of a black man killed by a Montgomery police officer in February has filed a federal lawsuit against the city and the officer.

Court documents show that the lawsuit filed July 8 argues Officer Aaron Smith did not have cause to use force or even stop Greg Gunn, who was walking home from a late-night card game. The lawsuit also accuses the Montgomery Police Department of failing to properly train officers and allowing officers to stop and question black citizens without cause.

Smith is charged with murder in the Feb. 25 death of 58-year-old Gunn. His case has been bound over to a grand jury.

The lawsuit was filed by Gunn’s mother, Nellie Ruth Gunn.

A lawyer for the Gunn family could not be reached for comment. A city spokesman said they could not comment on ongoing litigation.
