Inmate on inmate assault leads to murder investigation in Perry Co.

A murder investigation is underway in Perry County — following the death of a 69 year old inmate — at the county jail.

Perry Co. District Attorney Robert Turner, Jr. says the death appears to be the result of an inmate on inmate assault.

Twenty-six year old Damion Allen of Marion is accused of brutally assaulting 69 year old Frank Russell during the overnight hours at the Perry County Jail.

“He did not pass away immediately after the incident,” said Turner.

“But later on during the week, on last week Mr. Russell did succumb to his injuries.”

Now Allen who was in jail on a criminal mischief charge — is also charged with murder. And the circumstances surrounding the case are under investigation.

“Officers from the State Bureau of Investigation were called in to assist Sheriff Billy Jones in the investigation of the matter. After preliminary investigation and some interviews with witnesses, a decision was made to charge Mr. Damion Allen with the murder of Mr. Russell.”

Russell was in the county jail waiting to go to state prison — after pleading guilty to sexual abuse 1st degree.

Turner says a court date for the murder case against Allen — has not been set at this time.
