Court Documents Give Details of Sodomy Charges Against MPD Officer
The Montgomery Police Department has initiated disciplinary proceedings against one of their fellow police officers, after charging him in connection with the sexual assault of an adult male.
MPD charged Deonte Lashawn Hamner with first-degree sodomy Tuesday, June 14, and placed him in the Montgomery County Detention Facility under a $60,000 cash bond. First-degree sodomy is a Class A felony.
MPD initiated the investigation June 14 after receiving allegations of sexual assault involving an on-duty police officer. The assault is alleged to have occurred after the officer stopped the victim’s vehicle relative to a noise complaint.
An affidavit filed in Montgomery County District Court Wednesday, June 15 says 27-year-old Hamner is accused of forcing a man to perform oral sex on him at gunpoint June 9.
Department of Public Safety Spokeswoman Martha Earnhardt said in an emailed statement that police began investigating allegations against Hamner on Tuesday.
Hamner, who graduated from the police academy in 2014, has been placed on administrative leave.
Section 13A-6-63
Sodomy in the first degree.
(a) A person commits the crime of sodomy in the first degree if:
(1) He engages in deviate sexual intercourse with another person by forcible compulsion; or
(2) He engages in deviate sexual intercourse with a person who is incapable of consent by reason of being
physically helpless or mentally incapacitated; or
(3) He, being 16 years old or older, engages in deviate sexual intercourse with a person who is less than
12 years old.
(b) Sodomy in the first degree is a Class A felony.
