The public health department’s initial reports show more than 80 children became ill with Staph infection because of something they ate at Sunnyside Daycare on June 23rd.
And many had to be taken to the emergency room.
“Had those DHR regulations been in place, this never would have happened,” said prosecuting Attorney Joe Hubbard.
Hubbard is representing 73 claims from parents and children in lawsuits against the daycare.
He says DHR was not involved because the daycare found a loophole in the system.
The daycare registered as a church and did not have to be governed by the state.
“It’s important that folks understand that this lawsuit is about more than food poisoning. It’s about a daycare that has purposely set up a scheme to evade the licensure and regulations put in place by DHR to protect children in day cares.”
There was a hearing Wednesday afternoon.
Sunnyside Daycare requested to consolidate what is now more than 100 claims against them.
Hubbard will be leading the case.
