Andalusia City Council race ends in tie, so who will serve?

Action 8 News was in Andalusia where the votes were certified for a city council race that ended in a tie. So how was the tie broken?

As we have reported, the District 4 city council runoff ended with incumbent Presley Boswell and challenger Greg Palmer each receiving 183 votes on September 23.

There was one provisional ballot cast in the race, which could have broken the tie. But it was determined that the voter didn’t live in the district, so that vote could not be counted.

The next option was for city council to make the decision, or else it would be up to the Covington County Probate Judge.

The city council decided unanimously that Boswell would continue in his seat.

But Palmer has called for a recount. Alabama law requires the person requesting the recount to pay for it to be conducted, according to Mark Christensen, the city attorney. Palmer has provided $10,000 to cover the expenses.

A date for the recount hasn’t yet been set. Polling officials who worked during the September 23 runoffs will need to be present.
