The Chief Justice of Alabama’s highest court is once again saying no to same-sex marriage.
The order from Alabama Supreme Court Chief Justice Roy Moore is once again calling on probate judges in the state to not issue same sex marriage licenses.
The order issued Wednesday is a response to the United States Supreme Court ruling paving the way for same sex marriage back in June.
Chief Justice Moore says some probate judges are issuing them, others are not, and some are out of the marriage license business all together, claiming this had created “confusion and uncertainty.”
Moore says right now he can’t clear up that confusion, because the U.S. Supreme Court ruling contradicts the state’s highest court’s stance.
So until the Alabama Supreme Court changes it’s position on the issue, Moore says probate judges should not issue same-sex marriage licenses.
Montgomery County Probate Judge Steven Reed says that this is an embarrassment to the state and his office will ignore it. “Anytime you have the Chief Justice, with all the serious issues that the court system is facing, the serious issues that this state is facing, and the serious issues before us, that we are dealing with something that’s already been decided by the US Supreme Court…when the United State Supreme Court speaks, it speaks. So you can try to find some loop hole or some unsubstatiated case law that’s not going to stand up in any federal court, it is not going to stand up anywhere challenged. And waste tax payer time and waste tax payer dollars defending it all in a matter of what your personal political agenda is. That’s not what the Chief Justice of the Supreme Court should be doing,” Reed said.
Judge Reed says his office will continue to issue same-sex marriage licenses.
