Alabama Lawmaker In Court For Perjury Charges

An Alabama lawmaker was in court today trying to have perjury charges thrown out. 

Representative Barry Moore of enterprise is accused of lying to the lee county grand jury that’s investigating corruption in state government. 
 
Moore was in court for about an hour and his defense stated that there were problems not only with the indictment but with the entire grand jury process.
 
Barry Moore’s lawyer is former attorney general Bill Baxley. He argued that the prosecution went about the indictment all wrong so it shouldn’t even count.
 
“The indictment is bad. It’s not in proper form as required by the code of Alabama. In fact it’s not worth the paper it’s written on,” said Baxley. 
 
Baxley also says the acting attorney general in the grand jury doesn’t have any authority since there’s no documentation of how he was appointed. Attorney general luther strange recused himself from the process.
 
He says it all boils down to law. 
 
“There are certain laws you have to follow to put someone on trial and they haven’t followed them,” said Baxley. 
 
But the prosecution says they followed the law correctly and the defense doesn’t have any evidence to support their case. 
 
Representative Moore didn’t have anything to say himself as he left court, but another one of his attorney’s had this to say. 

“We’ll wait for the court to rule in this matter and the court will characterize what it is for us,” said attorney Joel Dillard. 
 

Nothing was decided today. The judge is waiting for the prosecution to bring evidence of the acting attorney general’s appointment later this week. 
 
Moore is accused of lying about threatening his opponent in the upcoming June 3rd Republican primary. The indictment says he told his opponent that Speaker of the
House Mike Hubbard would pull economic funding if he didn’t drop out of the race.
